Terms of Use

These terms of use regulate the relationship between an individual or legal entity (hereinafter referred to as the User), on the one hand, and AMGarage OÜ (KiirCarAbi in the Internet environment), on the other hand (hereinafter collectively referred to as the Parties).

By registering and starting to use KiirCarAbi, the user confirms that:

  • he is at least 16 years old
  • he has read the terms of this agreement, agrees with them and undertakes to comply with them

Conditions
1. Definitions

  • 1.1 KiirCarAbi is a virtual environment located on the Internet and owned by AMGarage OÜ.
  • 1.2 User – an individual or legal entity registered in the KiirCarAbi system.
  • 1.3 Account – a virtual account of an individual or legal entity in the KiirCarAbi system.
  • 1.4 Service — a service provided to the user by AMGarage OÜ in the KiirCarAbi system, which also includes account registration.
  • 1.5 Terms of Use — this document regulates the relationship between KiirCarAbi and the user, and also regulates the legal grounds.
  • 1.6 A legal act is a law in force on the territory of the Republic of Estonia.

2. Rights and obligations of AMGarage OÜ

  • 2.1 AMGarage OÜ is not responsible for any disputes between users of the KiirCarAbi website, including litigation, claims and demands.
  • 2.2 AMGarage OÜ shall not be liable under any circumstances for damages arising from the use or inability to use the services provided.
  • 2.3 AMGarage OÜ has the right to remove, change and stop advertising of the user's services or goods on the KiirCarAbi website without warning, at its own discretion.
  • 2.4 AMGarage OÜ has the right to unilaterally change the terms and conditions, which come into force from the moment of their publication on the KiirCarAbi website.
  • 2.5 AMGarage OÜ has the right to restrict access or block users if users cause damage to the KiirCarAbi website, create various legal problems, violate laws, intellectual property rights or other agreements, and demand compensation for damages (lost profits and costs associated with interrupted commercial activities).
  • 2.6 AMGarage OÜ has the right to change the terms of use without notice.
  • 2.7 AMGarage OÜ has the right not to respond to user letters, as well as to ignore requests, demands or inquiries that contradict legal acts, these or additional terms of the agreement.
  • 2.8 AMGarage OÜ undertakes to ensure the provision of services, if this does not contradict the terms of these terms of use. AMGarage OÜ has no obligation to ensure the provision of services on the KiirCarAbi website, if this damages its reputation in the eyes of other users, is in itself economically damaging for AMGarage OÜ, is impossible due to force majeure, for technical reasons or for any other reason that violates the interests of other users.

3. User rights and obligations

  • 3.1 The user is solely responsible for providing false information about himself on the KiirCarAbi website.
  • 3.2 The user undertakes to conduct themselves on the KiirCarAbi website in accordance with these terms, in good faith and in accordance with the legislation in force in Estonia.
  • 3.3 The User undertakes to immediately notify AMGarage OÜ of any problems related to the use of the KiirCarAbi website.
  • 3.4 The User undertakes not to perform actions that would create an excessively high load on the infrastructure of the KiirCarAbi website; not to use any automatic programs to collect or access information on the KiirCarAbi website.

4. Responsibilities of the parties

In case of improper fulfillment of obligations undertaken in accordance with these Terms of Use, the parties bear the responsibility provided for in legal acts.

5. Confidentiality

  • 5.1 The user gives permission to AMGarage OÜ to process, use their personal data and send messages.
  • 5.2 AMGarage OÜ undertakes not to disclose the user's personal data to third parties, except in cases provided for by legal acts.

6. Messages

AMGarage OÜ sends personal messages to the user to the specified e-mail. Such messages are considered received by the user after five (5) business days from the date of sending.

7. Dispute resolution

Disputes are resolved through negotiations. If this is not possible, the dispute is resolved in court.

8. Violation of the Terms of Use

Violation of the Terms of Use is:

  • 8.1 providing false, inaccurate or misleading information;
  • 8.2 distributing spam and sending messages to other users without their consent (including mass mailing);
  • 8.3 distribution of computer viruses or other technologies that may harm the KiirCarAbi website or its users;
  • 8.4 any activity that damages the reputation of the KiirCarAbi website in the eyes of other users, interrupts the correct operation of the KiirCarAbi website (including reducing security and reducing the number of active users), reduces the quality of services and profits of AMGarage OÜ, and also violates the interests and rights of other users;

9. Payment for services

  • 9.1 Registration is free.
  • 9.2 AMGarage OÜ reserves the right to change prices for services at any time without prior notice.
  • 9.3 Payment for services can be made in various ways. AMGarage OÜ is not responsible for any losses related to the correct operation of payment systems.
  • 9.4 In case of violation of the Terms of Use, AMGarage OÜ reserves the right not to return unused funds to the user.

10. Refusal to execute these Terms of Use

  • 10.1 Refusal to comply with these Terms of Use leads to blocking of the user's account, but does not relieve the user from fulfilling the obligations arising from these Rules of Use.
  • 10.2 AMGarage OÜ has the right to unilaterally refuse to comply with these Terms of Use by blocking the user's account if the user fails to fulfill their obligations under the terms of these Terms of Use, demand fulfillment of obligations, a penalty and file a lawsuit.

Other conditions

  • In case of violation of these terms AMGarage OÜ may demand a penalty, the user undertakes to compensate AMGarage OÜ for lost profits and expenses related to the interruption of correct commercial activity. Payment of the penalty does not release the user from fulfilling obligations.
  • The obligations set out in these Terms of Use shall be fulfilled no later than five (5) working days from the date of submission of the relevant demands by the user or AMGarage OÜ.
  • In the event that the KiirCarAbi website was not working due to technical reasons, as a result of which the user was unable to use the service purchased from AMGarage OÜ in full or in part, AMGarage OÜ gives the user the opportunity to add unused days or return unused money based on a written application submitted no later than 30 days from the date of resumption of the KiirCarAbi website. The application will be reviewed within 20 working days.
  • If the user is sure that the blocking of his account by AMGarage OÜ is unfair, the user has the right to submit a written statement to AMGarage OÜ. The statement will be reviewed within 20 working days. If AMGarage OÜ decides in favor of the user, the blocking of his account will be removed. AMGarage OÜ reserves the right not to respond to the statement.
